Tuition fees are the lifeblood of every private educational institution. Without tuition
fees or the delay in the collection thereof, the existence of every private school will
be placed in jeopardy. Given such, every school is given several options to enforce
the payment of tuition fees. One of the option is the enforcement of the no
payment, no test policy. It is therefore the opinion of the Law Firm of Sarmiento
and Delson that said policy could be validly enforced in our educational institutions
However, the following are the limitations in the enforcement of this policy, to wit:
a. The policy must be known to the parents upon the start of the school year;
b. There must be a formal demand to pay addressed to the parent with a
warning that failure to settle tuitions fees will result in the failure of the student
to take major examinations;
c. The policy should not apply to the final or semestral examinations because
the remedy in this case is the withholding of the final grades; and,
d. If the student pays after the major examinations, he or she is entitled to a
special exam.
